Terms & Conditions of Trading


Lampfix (The Company) transacts business only subject to the following conditions. No purchaser’s conditions shall override these.

1. Title and Risk

Title to the goods shall not pass to the Purchaser until the invoice price and any other money is paid in full, although risk in the goods passes to the Purchaser on receipt.

2. Delivery

Although every effort will be made to fulfil delivery dates, no liability arising from delay is accepted by the company.

3. Damage, Shortage, Non-Delivery

Any shortages or discrepancies must be reported within 3 days of delivery and confirmed in writing within 7 days of delivery or no claims will be accepted by the Company.

It is the responsibility of the Buyer to examine goods for defects in materials and/or workmanship which are likely to cause damage or injury.

4. Terms of Payment, Bankruptcy, Liquidation

Payment is STRICTLY net and due on presentation of invoice, unless full prepayment has been made or a different payment term has been expressly agreed.

The Purchaser agrees to accept a surcharge of any expenditure incurred by the Company if the Company decides to instruct a third party to attempt to collect on behalf of the Company any overdue amount owing to it. Also, the Company shall give to the third party any necessary information about the purchase to enable the sums to be collected. Should the purchaser make any breach of obligation to the Company or any bankruptcy be filed by or against the purchaser or be unable to pay debts within the meaning of the insolvency act 1986 the Company shall have the right forthwith to cancel any subsisting contract and stop any outstanding deliveries without remedy or consequential loss through non completion of contract.

5. Special Orders

Any order specially produced or altered items may not be cancelled or returned.

6. Waivers

No waiver by the Company, in any one, or more instances, in insisting on its rights under these conditions shall be construed as a future waiver or relinquishment of its rights and the Purchaser’s acceptance of the Company’s conditions of sale shall continue in full force and effect.

7. Liability

The Company shall not be liable to the Buyer for damage to goods or injury to persons resulting from negligent or improper use or handling of goods by the customer, his employees or agents, or members of the general public.

The Company shall not be liable to the buyer for any loss of profit or contracts or other consequential loss of any kind contingent upon acts or omissions of the company however caused.

Illustrations, descriptions, weights are taken as a guide only and are not binding in detail. The Company reserves the right, without notice and without affecting the validity of the contract to make changes in materials, dimensions, design and prices as are reasonable or desirable.

Advice, information and opinion given by any employee or agent of the Company is given without legal responsibility. Any recommendation or suggestion relating to the goods made or supplied by the company either in technical literature or in response to specific enquiry, in given in good faith, but it is for the Buyer to satisfy himself of the suitability of the goods for his particular purpose, and he shall be deemed to have done so.

8. Returns

All returns must be accompanied by the correct returns paperwork available from the Company on request in order for credit to be raised against the returns. Returned goods must be in perfect condition for credit to be received by the returner. Handling charges may apply. The Company will accept return of goods only within 30 days of the goods date of purchase. Clearance items may not be returned.  Custom-made, cut-to-length cable or bespoke to order items, may not be returned. Products ordered in bulk (6 or more of the same item code) may not be returned without prior authorisation from the Company.

9. Your personal information

Our website includes areas where you are requested to provide information about yourself. Any personal data you provide to us through our website or by telephone, post, fax, email or in person shall be subject to the terms of our Privacy Policy which also forms part of these terms.

10. Force Majeure

Neither party shall be liable to the other party for the delay in any performance or failure to render any performance under this Agreement when such failure or delay is caused by governmental regulations, fire, strike, war, flood, accident, epidemic, embargo, appropriation of plant or product in whole or in part by any government or public authority, or any other cause or causes, whether of like or different nature, beyond the reasonable control of such party as long as such cause or causes exist.

11. General

These terms and the use of our website and its content shall be governed by and construed in all respects in accordance with English law. We and you agree that the English courts shall have exclusive jurisdiction to settle any claims or proceedings relating to these terms or their subject matter.

Although this Website may be linked to other websites, we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked website, unless specifically stated herein.

You should carefully review the legal statements and other conditions of use of any website which you access through a link from this Website. Your linking to any other off-site pages or other websites is at your own risk.

Navigator Warranty Statement

Navigator Warranty Statement


This Limited Warranty specifically applies to products purchased from the Navigator Range purchased from Lampfix (the "Products").


1. Warranty Period:

All Navigator Products sold by Lampfix are covered by our 10-year warranty, effective from the date of purchase.


2. Warranty Registration: 

To activate the 10-year warranty, customers must register their Navigator product on the Lampfix website within 30 days of purchase. Failure to register within this timeframe may result in the default coverage period.


3. Coverage:

3.1 ​ This warranty does not cover replacement glass, natural variations in color, or installation costs.

3.2 Accidental damage and/or consequential loss of the product or parts of the products are not covered by the warranty.

3.3 ​ Damages and faults caused by pests/insects are not covered by the warranty. 


4. How to Obtain Repairs or Remedies:

Customers experiencing issues with a covered product should initiate the warranty process by notifying Lampfix's customer service within the warranty period. This can be done by visiting our website or contacting our dedicated support team.


5. Warranty Handling Process:

Once initiated, Lampfix will evaluate the reported issue. If a defect in material or workmanship is confirmed, Lampfix will, at its option, repair or replace the defective product, part, or component.


6. Repair Terms:

6.1 ​ Free Repairs: Warranty repairs are free of charge during the warranty period.

6.2 ​ Use of Parts: Lampfix will use new, used, or refurbished parts at its discretion for warranty repairs.

6.3 Replacement with New Products: Damaged products may be replaced with new ones instead of being repaired, at Lampfix's discretion.


7. Items No Longer Covered by Warranty:

7.1 If a product is no longer covered by the warranty, Lampfix offers repair services at a reasonable cost. Customers can contact our customer service for product repair options outside the warranty period.


7.2 Unavailability of Replacement Parts: Lampfix is committed to providing quality products and support. In the event that a necessary part for repair or replacement is no longer available due to the original manufacturer discontinuing it, the following provisions apply:


7.2.1 Lampfix will make reasonable efforts to source alternative parts for repair or replacement. However, if a suitable replacement part cannot be found, Lampfix will communicate this to the customer.


7.2.2 If the product is within the warranty period, Lampfix will explore alternative resolutions, such as providing a replacement product of similar value or offering a reasonable discount on a new purchase.


7.2.3 If the product is outside the warranty period and the needed part is unavailable, customers may opt for paid repair services offered by Lampfix.


7.2.4 Refunds will not be offered solely due to the unavailability of replacement parts. Customers are encouraged to contact Lampfix's customer service for guidance and available options.


8. Returns and Warranty Interplay:

8.1 ​ For products returned within the 30-day window due to dissatisfaction, the standard returns policy applies.

8.2 ​ Defective or incorrect products reported within 7 days of receipt are eligible for warranty coverage, and Lampfix will rectify the issue through repair or replacement as per the warranty terms.

8.3 Refund Policy: For purchases made directly through Lampfix, our refund policy is as follows:


8.3.1 Refunds are only applicable to purchases made directly through Lampfix. If the product was purchased through a reseller, customers should refer to the reseller's refund policy.


8.3.2 Refund requests must be submitted within 30 days from the date of purchase. Requests received after this timeframe will not be eligible for a refund.


8.3.3 Refunds will be processed in accordance with Lampfix's assessment of the situation, and may involve a restocking fee or other applicable charges.


8.3.4 Refunds will be issued using the original payment method, unless otherwise agreed upon by Lampfix.


9. Governing Law:

This warranty along with any associated claims, disputes, or legal matters, is governed by English law.


This warranty statement is subject to Lampfix's Terms and Conditions of Trading.


Additional Terms and Conditions


1. Warranty and Returns:

For warranty claims and returns, please refer to Lampfix's separate Warranty Statement and Returns Policy, which are integral parts of these Terms & Conditions.


2. Warranty Registration:

Customers are required to register their products within 30 days of purchase to activate the 10-year warranty. Failure to register within this period may result in default coverage.


3. Limitations of Warranty Liability:

Lampfix's liability under warranty is limited to the repair or replacement of defective products, parts, or components, as outlined in the separate warranty statement.


4. Returns Handling Process:

The handling of returns is subject to the terms outlined in the Returns Policy. Customers must follow the specified process, including providing the correct returns paperwork, to initiate the returns and credit process.


5. Handling of Special Orders in Returns:

Special orders, including custom-made, cut-to-length cable, or bespoke items, may not be canceled or returned unless otherwise specified in the Returns Policy.


6. Handling of Bulk Orders in Returns:

Products ordered in bulk (6 or more of the same item code) may not be returned without prior authorization from Lampfix.


7. Handling of Personal Information in Returns:

The handling of personal information provided during the returns process is subject to Lampfix's Privacy Policy.


8. Continued Effect of Terms:

These terms and conditions, along with associated policies, shall continue to be in full force and effect even if any particular clause is waived or not enforced.


9. Communication of Changes:

Lampfix reserves the right to make changes to these terms, the Returns Policy, and the Warranty Statement without notice. Any changes will be communicated through the Lampfix website.


These additional clauses ensure comprehensive coverage of warranty, returns, and associated matters, in coherence with the existing Terms and Conditions of Trading governed by English law.


Terms and Conditions for Lamp Repairs, Upgrades and Custom Work


1. Terms and Conditions for Lamp Repairs

1.1 ​All Prices exclude VAT

1.2 ​Quotations are valid for 30 days.

1.3 ​All work carried out by Lampfix is subject to these Terms and Conditions unless exception is given in writing prior to work commencing.

1.4 ​Lampfix may update Terms and Conditions at any time.  

1.5 ​Items left with Lampfix are left entirely at the owner's risk.

1.6 ​Lamps not collected by agreed date will be subjected to a £25 per week storage charge.


2. Invoicing and Payment

2.1 ​Payment for Lamp Repairs or Bespoke Manufacture is to be made in full before lamps are collected or delivered unless exception is given in writing prior to work commencing.

2.2 ​Any works cancelled after works have commenced will incur stand-down charges.



3. Ordering

3.1 ​Before any work can commence, a written instruction must be issued by the client.  This may take the form of a purchase order.

3.2 ​Any work outside the scope of the original quote, must also be requested and agreed in writing.

3.3 ​Lead time is dependent on workshop diary at the time of ordering.


4. Specific Exclusions

4.1 ​Price submitted is subject to review and agreement of contract terms.

4.2 ​Lamp repairs as instructed by client, carried out by Lampfix are guaranteed for 1 year from Electrical test date affixed to fitting.  This does not apply to any damage resulting from misuse. 

4.3 ​Lighting manufacture, as instructed by client, carried out by Lampfix are guaranteed for 3 years from Electrical test date affixed to fitting.  This does not apply to any damage resulting from misuse.


5. Supply Chain Delays


5.1 Goods and Materials

In the event that Lampfix is required to source specific goods or materials for a project, any delays caused by the supplier, including delivery delays, breakages in transit, or other unforeseen circumstances, shall not be the responsibility of Lampfix.


5.2 Services by Third-Party Providers

In cases where Lampfix engages third-party providers for specialized services (e.g., specialist metalwork), any delays in the provision of these services due to circumstances beyond Lampfix's control, including but not limited to the third-party provider's scheduling issues or unexpected challenges, shall not be the responsibility of Lampfix.


5.3 Communication of Delays

Lampfix will make reasonable efforts to communicate any anticipated delays to the client as soon as they become apparent. However, Lampfix shall not be held liable for any resulting project delays.


5.4 Adjustments to Timelines

In the event of supply chain delays, Lampfix reserves the right to adjust project timelines accordingly. The client will be informed of any necessary adjustments to the agreed-upon schedule.


5.5 Alternative Solutions

Lampfix will make reasonable efforts to find alternative solutions to mitigate the impact of supply chain delays, such as sourcing alternative suppliers or adjusting project plans where feasible. Any additional costs incurred as a result of such adjustments may be communicated to the client.


5.6 Force Majeure

Lampfix shall not be held responsible for delays or failure to perform any obligations under this agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, war, civil unrest, strikes, natural disasters, or any other force majeure events.

This Privacy Notice applies to all products and services offered by Lampfix which is a partnership registered in England whose registered address is Unit 6 Fen End, Stotfold, Hitchin Herts SG5 4BA.  We are registered on the Information Commissioner's Office Register of Data Controllers under registration number ZA368917.  This registration covers all of our different business partnership trading names.

2. How we collect information

To the extent permissible under applicable law, we collect information about you and any other party whose details you provide to us when you:


register to use our website; this will include your name, address, email address and telephone number. We may ask you to provide additional information about your business and preferences on a voluntary basis;

 

place an order for products or services on our website, this will include your name (including business name), address, contact details (including telephone number and email address) and your payment details;

 

complete online forms (including callback requests), take part in surveys, write posts on any message boards, post any blogs, enter any competitions or prize draws, download information such as white papers or other publications, or participate in any other interactive areas that appear on our website or which we offer to you from time to time

provide your contact details verbally over the telephone to one of our personnel;

To the extent permitted by applicable law, we retain information about you after the closure of your Lampfix account, if your application for a Lampfix account is declined or if you decide not to proceed. This information will be held and used for as long as permitted for legal, regulatory, fraud prevention and legitimate business purposes.


We  never record or store credit card information from our customers, and always rely on trusted third-party PCI-DSS-compliant payment processors for credit card processing (currently Stripe and Paypal), including for recurring payment processing.


Our website, applications (including mobile applications) and services may contain technology that enables us to:


- check specific information from your device or systems directly relevant to your use of the websites, applications or services against our records to make sure the websites, applications or services are being used in accordance with our end-user agreements and to troubleshoot any problems;

- obtain information relating to any technical errors or other issues with our website, applications and services;

- collect information about how you and users use the functions of the features of our website, applications and services; and

- gather statistical information about the operating system and environment from which you access our applications or services.

You can manage your privacy settings within your browser or our applications and services (where applicable).


In addition to the purposes described in this section 3, we may also use information we gather to deliver targeted advertising, marketing or information to you which may be useful, based on your use of the website, applications or services or any other information we have about you (depending on the websites, applications or services, you may able to configure these features to suit your preferences). Section 6 of this Privacy Notice provides further details on how we will do this.


We may monitor and record our communications with you, including e-mails and phone conversations. Information which we collect may then be used for training purposes, quality assurance, to record details about our website, applications and services you order from us or ask us about, and in order to meet our legal and regulatory obligations generally.


Data analytics and benchmarking

We may use information generated and stored during your use of our services for our legitimate business interests to enable us to give you the best service and/or solutions and the best experience. These purposes include to:


- deliver advertising, marketing (including in-product messaging) or information to you which may be useful to you, based on your use of services;

Whenever we use your information for our legitimate interests, we will ensure that your information is processed on a pseudonymised basis and displayed at aggregated levels, which will not be linked back to you or to any living individual.

We may share your information with:

- our service providers and agents (including their sub-contractors) or third parties which process information on our behalf (e.g. internet service and platform providers, payment processing providers and those organisations we engage to help us send communications to you) so that they may help us to provide you with the applications, products, services and information you have requested or which we believe is of interest to you;

- partners, including system implementers, resellers, independent software vendors and developers that may help us to provide you with the applications, products, services and information you have requested or which we believe is of interest to you;

- third parties used to facilitate payment transactions, for example clearing houses, clearing systems, financial institutions and transaction beneficiaries;

- third parties where you have a relationship with that third party and you have consented to us sending information (for example social media sites or other third party application providers);

- third parties for marketing purposes (e.g. our partners and other third parties with whom we work and whose products or services we think will interest you in the operation of your business activities. For example, financial services organisations (such as banks, insurers, finance providers), payment solutions providers, software and services providers that provide business solutions);

- credit reference and fraud prevention agencies;

- regulators to meet our legal and regulatory obligations;

- law enforcement agencies so that they may detect or prevent crime or prosecute offenders;

- any third party in the context of actual or threatened legal proceedings, provided we can do so lawfully (for example in response to a court order);

- any third party in order to meet our legal and regulatory obligations, including statutory or regulatory reporting or the detection or prevention of unlawful acts;

- our professional advisors and auditors for the purpose of seeking professional advice or to meet our audit responsibilities;

- another organisation if we sell or buy (or negotiate to sell or buy) any business or assets;

- another organisation to whom we may transfer our agreement with you; and

- Government departments where reporting is mandatory under applicable law.


We may share non-personally identifiable information about the use of our website, applications, products or services publicly or with third parties but this will not include information that can be used to identify you.


5. Marketing

From time to time, we may use your information to contact you with details about our products and services which we feel may be of interest to you. We may also share your information with carefully selected third parties so that they (or we) may contact you with information about their products or services which we feel may be of interest to you. We or they may wish to contact you for this purpose by telephone, post, SMS or email. You have the right at any time to stop us from contacting you for marketing purposes. You may also request at any time that we do not share your information with third parties referred to in this paragraph. If you wish to exercise these rights you can do so by selecting your contact preferences at the point where you provide us with your information on our websites, applications or services, using any preference centres we give you access to or by sending us an email to mail@lampfix.co.uk. You can also unsubscribe from any email marketing using the links provided in the emails we send to you.

Third party platform advertising:

Where you respond to communications we post on third-party platforms (such as Facebook, Google and Twitter), we may also share your information with those third parties in order to serve targeted advertising/content to you via the relevant third party platform based on your profile/interests.  Your information is used by the third-party platform provider to identify your account and serve advertisements to you.  You can control what advertisements you receive via the privacy settings on the relevant provider’s platform and you should consult the third party’s help/support centre for more information.

 

6. Accessing, updating or deleting your personal information and your rights

If you are based within the EEA or within another jurisdiction having similar data protection laws, in certain circumstances you have the following rights:


- the right to be told how we use your information and obtain access to your information;

- the right to have your information rectified or erased or place restrictions on processing your information;

- the right to object to the processing of your information e.g. for direct marketing purposes or where the processing is based on our legitimate interests;

- the right to have any information you provided to us on an automated basis returned to you in a structured, commonly used and machine-readable format, or sent directly to another company, where technically feasible (“data portability”);

- where the processing of your information is based on your consent, the right to withdraw that consent subject to legal or contractual restrictions;

- the right to lodge a complaint with the supervisory authority responsible for data protection matters (e.g. in the UK, the Information Commissioner’s Office).

- If you request a copy of your information you may be required to pay a statutory fee.


If we hold any information about you which is incorrect or if there are any changes to your details, please let us know by so that we can keep our records accurate and up to date.


If you withdraw your consent to the use of your personal information for purposes set out in our Privacy Notice, we may not be able to provide you with access to all or parts of our website, applications, and services.


We will retain your personal information for the duration of our business relationship and afterwards for as long as is necessary and relevant for our legitimate business purposes, or as otherwise permitted by applicable laws and regulations. Where we no longer need your personal information, we will dispose of it in a secure manner (without further notice to you).

We may change this Privacy Notice from time to time. However we will not reduce your rights under this Privacy Notice. We will always update this Privacy Notice on our website, so please try to read it when you visit the website (the ‘last updated’ reference tells you when we last updated this Privacy Notice).

 

8. Security and storage of information

We realise how important and sensitive your personal data is, and we take a great number of measures to ensure that this information is securely processed, stored and preserved from data loss and unauthorised access. Our technical, administrative and organisational security measures are described in details in our Security Policy.

 

We will keep your information secure by taking appropriate technical and organisational measures against its unauthorised or unlawful processing and against its accidental loss, destruction or damage. We will do our best to protect your personal information but we cannot guarantee the security of your information which is transmitted to our website, applications or services or to other website, applications and services via an internet or similar connection. If we have given you (or you have chosen) a password to access certain areas of our websites, applications or services please keep this password safe – we will not share this password with anyone.

Data Retention

Account & Contact Data: we will only retain such data as long as necessary for the purpose for which it was collected, as laid out in this policy, including any legal retention period, or as long as necessary to carry out a legitimate and reasonable promotion of our products and services.  

Browser Data: we will only retain this data for a short period of time, generally 6 months, unless we need to archive it in relation with a legitimate concern related to the security or performance of our services, or as required by law.

Safety Retention Period:

As part of our Security Policy, we always try to preserve your data from accidental or malicious deletion. As a result, after we delete any of your personal information (Account & Contact Data) from our database upon request from you, or after you delete any personal information from your online account, it may not be immediately deleted from our backup systems. It could remain stored for up to 6 months, until it is ultimately destroyed.

We commit not to use those backup copies of your deleted data for any purpose except for maintaining the integrity of our backups, except if you or the law require us to do so.

 

9. Transfers outside Europe
